Welcome to TheReal 1776 Limited LLC – America’s New Main Street! We’re building a marketplace dedicated to quality products Made in the USA, supporting American makers, workers, and values rooted in freedom and self-reliance.
As a vendor, you help make this vision real. These Vendor Terms and Conditions outline your rights, responsibilities, and the rules for selling on our platform. By opening and operating a store on TheReal 1776 Limited LLC, you agree to these terms, our main Terms of Use, Privacy Policy, and all other platform policies.
1. Platform Fees
TheReal 1776 Limited LLC charges a 7% commission on the sale value of each item sold, and a small ($1.99) per order fee (excluding shipping/taxes unless specified). There are no listing fees, no monthly membership fees, or hidden charges. Commissions are deducted automatically from payouts. 2. What Can Be Sold
TheReal 1776 Limited LLC is exclusively for Made in the USA products. All items must be:
- Manufactured or assembled in the United States (all or virtually all significant parts, processing, and labor must occur in the USA, per FTC guidelines).
- Repackaging imported goods does not qualify as “Assembled in the USA.”
- We encourage (but do not strictly require) 100% US-sourced materials. Vendors meeting this standard earn a special “100% Made in USA” badge for visibility.
Provide clear, honest documentation (e.g., origin certifications, supplier info) upon request to verify compliance. False claims violate FTC rules and our policies.
3. What Cannot Be Sold
Prohibited items include (but are not limited to):
- Items violating intellectual property rights (counterfeits, unauthorized use of trademarks/logos).
- Prohibited goods/services under our main Terms of Use (e.g., weapons, drugs, hazardous materials, adult content unless specified).
- Non-USA-made or assembled products.
We review flagged listings. Violations may result in removal, suspension, or account termination.
4. Honest Representation
Transparency builds trust. You agree to:
- Provide accurate, complete info in your shop About section and policies.
- Use truthful listings, photos, and descriptions (no misleading claims).
- Honor your shop’s stated policies (shipping, returns, etc.).
- Respect others’ intellectual property; report infringements via our system.
- Avoid fee avoidance, duplicate shops, search manipulation, coordinated pricing, or any policy circumvention.
5. Communication & Conduct
Use platform Messages only for legitimate order-related communication. Prohibited: spam, harassment, unsolicited promotions, interference (e.g., click fraud, negative review manipulation), or violating our Anti-Discrimination Policy.
6. Privacy & Data Protection
You must protect buyer/seller personal information (e.g., names, addresses, emails) and comply with all laws (US privacy laws, GDPR if serving EU buyers). Use buyer data only for TheReal 1776 Limited LLC transactions/communications. Do not add to mailing lists, market unsolicited, or retain payment info without consent.
If processing data outside the platform, you may be an independent data controller and must honor access/deletion requests. You indemnify TheReal 1776 Limited LLC for any claims/losses from your data handling. See our Privacy Policy for more.
7. Content Uploads
You own your content but grant us a license to display it. Do not upload abusive, obscene, infringing, or misleading content.
8. Reviews & Reputation
Buyers rate 1-5 stars. Respond professionally to reviews (especially <3 stars). Reviews/responses must not contain private info, spam, threats, or violate policies.
9. Customer Service Standards
Provide excellent service:
- Meet stated processing/shipping times.
- Respond to Messages promptly.
- Resolve issues directly; use our case system if needed.
- Cancel/refund promptly if unable to fulfill (full refund including shipping if paid).
Failure may affect your seller status or lead to restrictions.
10. Cancellations, Returns, Exchanges & Disputes
Comply with US laws.
Our Case System handles non-delivery or not-as-described claims. Respond within 3 days. If we rule against you, refund fully (including return shipping). Ineligible disputes (e.g., carrier damage, post-delivery alterations) should be resolved amicably.
11. Governing Law & Disputes
These terms are governed by applicable laws. Disputes resolved via binding arbitration, or small claims court where applicable. You agree not to pursue class actions.
12. Changes & Termination
We may update these terms (notice via email/dashboard). Continued use = acceptance. We can suspend/terminate for violations.
