TheReal1776 Limited LLC, DBA: TheReal 1776 (“we,” “us,” “our”) operates the website www.thereal1776.com (the “Site”), a multi-vendor online marketplace connecting buyers with independent U.S.-based sellers offering authentically American-made products.

These Terms and Conditions (“Terms”) govern your access to and use of the Site, including browsing, purchasing, selling as a vendor, creating an account, or any other interaction. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

We may update these Terms at any time. Continued use after changes constitutes acceptance. Check this page periodically.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site. By using the Site, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

2. Accounts

To buy or sell, you may need to create an account with accurate information.
You are responsible for maintaining confidentiality of your login credentials and all activity under your account.
We reserve the right to suspend or terminate accounts for violations, fraud, or at our discretion.

3. Marketplace Role

TheReal1776 is a platform facilitating transactions between buyers and independent vendors. We are not a party to sales contracts, do not take title to products, and are not responsible for:

Product quality, safety, legality, or accuracy of descriptions.
Vendor fulfillment, shipping, or customer service (except as mediated in disputes).
Payment processing disputes (handled by our gateways like Stripe/PayPal).

Vendors are solely responsible for their listings, compliance with laws (including FTC “Made in USA” standards requiring “all or virtually all” made in the U.S.), taxes, and customer interactions.

4. User Conduct

You agree not to:

Post false, misleading, infringing, or unlawful content.
Harass, spam, or impersonate others.
Attempt to hack, interfere with, or overload the Site.
Use the Site for illegal purposes.

We may remove content or terminate access for violations.

5. Products and Listings (for Vendors)

Vendors must provide accurate descriptions, prices, images, and origin claims.
Products must comply with all applicable laws (no prohibited items).
Vendors set their own shipping, return, and refund terms (displayed clearly on listings/storefronts).
We may review/remove listings that violate policies or laws.

Prohibited and Restricted Items and Content Policy

TheReal1776 is committed to being a welcoming, safe, and respectful marketplace where independent American makers and buyers can connect over high-quality, authentically made-in-USA products. To maintain this positive community environment and comply with applicable U.S. laws, we prohibit the listing, sale, or promotion of certain items and content.

We have a zero-tolerance policy for any items or listings that:

Promote, incite, glorify, or support hatred, violence, discrimination, or intolerance toward individuals or groups based on protected characteristics (including but not limited to race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or immigration status).
Glorify or support terrorism, violent extremism, criminal organizations, or acts of violence against people or American communities.
Contain graphic depictions of violence, self-harm, suicide, or victims of violence without clear historical, educational, or artistic context.
Violate U.S. federal or state laws, including those related to hate crimes, threats, or illegal activities.

Examples of prohibited items/content (this list is not exhaustive; we review on a case-by-case basis):

Items or designs that use derogatory language, symbols, or imagery targeting protected groups.
Products promoting or glorifying hate groups, extremist ideologies, or violence.
Listings with threats, harassment, or calls to harm others.
Counterfeit goods, unauthorized replicas, or items infringing intellectual property rights.
Hazardous materials, weapons, drugs, alcohol, tobacco, or drug paraphernalia (beyond standard legal restrictions).
Any content that could reasonably be seen as exploiting or endangering vulnerable individuals.

Vendors are responsible for ensuring their listings comply with this policy and all applicable laws (including FTC guidelines on truthful “Made in USA” claims). We may review, remove, or reject listings at our discretion if they violate these rules and/or don’t align with the site mission. Repeated or serious violations may result in account suspension or termination.

If you believe a listing violates this policy, please report it via support@thereal1776.com. We investigate reports promptly and fairly.

This policy helps ensure TheReal1776 remains a platform focused on celebrating American craftsmanship, fair trade, and mutual respect — without division or harm.

6. Orders and Payments

Placing an order creates a contract directly between buyer and vendor.
Prices and availability are set by vendors; we facilitate payment processing.
All payments are final unless vendor approves refund/exchange per their policy.
Taxes, shipping, and fees are calculated/displayed at checkout via Stripe.

7. Intellectual Property

All Site content (text, logos, design) is owned by us or our licensors. Limited license granted for personal, non-commercial use.
Vendors grant us a license to display their listings/content on the Site.
Respect copyrights/trademarks; report infringements via support@thereal1776.com.

8. Limitation of Liability

To the fullest extent permitted by law:

The Site is provided “as is” without warranties.
We are not liable for indirect, consequential, or punitive damages.
Our total liability shall not exceed the amount paid by you in the last 12 months (or $100 if none).
Vendors are solely liable for their products/services.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Site, violations of these Terms, or your content/transactions.

10. Termination

We may suspend/terminate access at any time for any reason. Upon termination, your account obligations survive.

11. Governing Law and Disputes

These Terms are governed by Oregon law (without conflict principles). Any disputes shall be resolved exclusively in courts of Multnomah County, Oregon.

12. Miscellaneous

If any provision is invalid, the remainder remains enforceable.
No waiver of rights unless in writing.
These Terms, Privacy Policy, and Refund/Returns Policy constitute the full agreement.
